Energy market price control appeal decision

The Competition and Markets Authority has published the final determination in the Energy Licence Modification Appeals 2021.

The CMA's Appeal Group, of which DT Economics Managing Partner David Thomas was a member, found in favour of Ofgem on most grounds - upholding its decision to reduce future returns allowed to investors. The group did, however, find that Ofgem had not provided sufficient evidence to justify two new adjustments that had reduced the amounts appellants could charge their customers.
